could prop 34 pass? >> that is unknown at this point but it stands a better chance today than three weeks ago. >> reporter: the cost argument, $100 million a year to keep it. there are strong arguments on both sides. >> what is the right punishment for the evil? it isn't just about the killer. >> it is about public policy. how do we spend, what keeps us safer? >> yes, it is cheaper to lock them up than to execute them. >> we waste a bunch of money either way. >> reporter: our poll found religious differences. catholics favorites it. prodstants oppose it -- pausestants oppose it. the bay area supports repealing the death penalty. southern areas of the state

oppose it. don't forget to vote tuesday. health and science editor john fowler ktvu channel 2 news. >> more details on the november 6 election. there is word results in california could be delayed because of the number of mail in ballots. they take longer to count because workers have to verify each signature and that could mean votes won't be tallied till the following day. >> be patient. >> california distributed 9 million mail in ballots this cycle. that is 20% more than were requested in 2008. it is predicted half of all california voters will vote by mail this year. in a investigation pleasanton and stockton police arrested a man who is accused of killing a woman. the body was found in may in

pleasanton. police identified the victim from stockton. investigators say he killed her and he has been booked on murder charges. there are reports the victim and suspect had dated in the past. a tourist looking out a window made a discovery today. he called for help this morning after sighting a body in the water. the person was a white man in his mid-30s but deputies found no injuries or cause of death. they are working to identify that body. a woman who claims she was a victim of sex abuse calls the response to her allegations appalling. she is a university of california at berkeley swim coach. two teachers abused her when she was a teen. one committed suicide. the other pleaded guilty.

the defense says her carelessness and negligence contributed to her abuse. the district attorney plans to change the way its prosecutes some immigrants to avoid convictions that require deportation. she is instructing prosecutors to consider filing lesser charges. two more planes are joining the relief effort to help victims of superstorm sandy. ktvu's ken pritchett joins us live with how they will help. ken? >> reporter: the air force will do what it does best and that is move an incredible amount of equipment in a matter of hours. >> the large cargo planes that make the effort possible but it

is the men and women who will do the real work. >> we have active duty, reserve, and we have family members. >> reporter: he says this c-17 plane is just one of two launched today at 2:00 a.m. the largest plane, the c5 was loaded up with equipment and 30 personnel to help. at march air force base, they will join planes that will be loaded up with 600 tons of supplies to support relief efforts on the east coast. including 60 vehicles from southern california edison. >> they will move equipment and personnel to new york that will allow us to turn the light switch on for the east coast.

>> reporter: some or all of these planes were scheduled to arrive on the east coast today but we haven't received a confirmation that they have arrived. the mission will last two weeks. ken pritchett, ktvu channel 2 news. san francisco based wells fargo is donating $1 million to relief efforts. the company announced 250,000 to the red cross. the remaining money goes to other non-profits that are working on relief and recovery efforts. if you would like to help you can make donations to the red cross at wells fargo atms. google created a map with up to date information. users can find idetails on -- find find details there and -- find details there.

nurses at six hospitals walked off the job today protesting their contract dispute. dozens walked the picket line this morning in oakland. the union says sutter is demanding reductions in patient care and standards in contracts. >> we are heroes every day that we go in to work. setting our contract. we are ready to bargain with them. >> a official tells ktvu channel 2 news the nurses are paid very well and urge the union to accept the company's office. ross posted a mix sales report today. same store sales in october rose 4%, that was higher than they expected but lower than wall street's predictions. that sent shares down 6%.

facebook is asking menlow park not to push for public benefits. facebook cfo says the company has given millions of dollars to menlow park. a proposed bev mo location may not make it. now they asked to have their application taken off of the agenda. they said the company is still evaluating the proposal. one person was injured today in a chain reaction crash on a san francisco freeway. the accident happened before 3:00 p.m. this afternoon on highway 101 before 280. news chopper 2 was over head

a neighborhood is vowing to find the person who shot and killed an owner of a cell phone store last night. police say he was killed during a robbery around 730 p.m. last night at his cell phone store. his store was a neighborhood main stay for 14 years. >> it is such a sad, sad

moment. not because of just what has been taken from us but what has been taken from everyone else. >> the family is putting together a reward for information in the killing. violence in san francisco's mission district is on the rise with officials pointing the finger directly at a growing gang problem. ktvu's david stevenson is live from the commission district with what police say they plan to do about it. david? >> reporter: last year there were 5 homicides, this year there have been 8 and that prompted the police to call for the public's help after a series of gang shootings here. >> reporter: friends and strangers gathered in the mission district to pray for a 19-year-old shot to death last week. >> everyone needs to transform so then this doesn't happen. >> reporter: one of three run related fatal shootings last

month. police say it marks an upticken gang violence. >> no opsides in san francisco in august -- homicides in san francisco in august. so to have three in one week is significant. >> all the shootings are gang related. >> reporter: there are no causes for the spike. investigators say they have made progress in the district. >> this last month we made 20 robbery arrests. 29 arrests for aggravated assaults assaults and we seized a total of 14 weapons and fire arms off of the street. >> police and community groups need the public's help to prevent further violence. >> we have folks that are scared to tell young men not to hang out. to say that is not the way to go. there are other options. >> reporter: police say

residents can call them anonymously. reporting live in san francisco, david stevenson, ktvu channel 2 news. the sheriff's office is investigating the death of a infant who was found unresponsive at a child care center last month. the baby was taken by ambulance to kaiser where he was pronounced dead. a autopsy has been performed but results are spending and the cause of death hasn't been determined. authorities are investigating whether a robbery of a store this week is linked to a string of other robberies. it was targeted by a group of armed, masked robbers tuesday afternoon. the robbers broke glass cases, threatened workers and stole jewelry. the sherriff's department says it may be linked to similar
